This Distance Sales Agreement is concluded between the Buyer, who places an electronic order via www.agam.com.tr, and the Seller, within the scope of the Consumer Protection Law No. 6502 and the Distance Sales Regulation.
By approving this Agreement electronically, the Buyer is deemed to have accepted all of its provisions.
1. Parties

1.2 Buyer
The real or legal person whose information appears on the order screen.
2. Subject of the Agreement
This Agreement regulates the rights and obligations of the Parties regarding the characteristics, sales conditions, and delivery of the products ordered electronically from the Seller’s website.
3. Product and Payment Information
The type of product, unit price, total amount, payment method, shipping fee, and delivery details are shown on the order screen and constitute an integral part of this Agreement.
4. Delivery Conditions

Products are delivered to the address specified by the Buyer.

Delivery times may vary depending on workload, weather conditions, production processes, and courier operations.

The Buyer must inspect the product during delivery and request a damage report from the courier officer if any damage, incorrect shipment, or missing item is detected.

If no report is issued at the time of delivery, responsibility rests with the Buyer.
5. General Provisions

The Buyer declares that they have read and accepted the preliminary information form and this Agreement.

The Seller reserves the right to partially or fully cancel the order due to stock shortages or operational requirements.

In such cases, the Buyer will receive a refund.
6. Undeliverable Orders
The Seller is not responsible, and no refund is issued, in cases where:

The Buyer provides an incorrect or incomplete address

The Buyer is not present at the address
-
Delivery is refused
Since the products are perishable food items, undelivered packages cannot be resold and are destroyed.
7. Right of Withdrawal and Exceptions
In accordance with Article 15/1-b of Law No. 6502, the right of withdrawal does not apply to perishable or fast-expiring goods.
The following products are not eligible for withdrawal:

Fresh baklava
-
Syrup-based desserts
-
Daily produced food items
-
Ready-to-consume products
-
Personalized or custom-packaged items
By confirming the order, the Buyer acknowledges and accepts that these products are exempt from the right of withdrawal.
8. Return Conditions
Returns are accepted only for defective products.
To qualify for a return:

Written notification must be made within 24 hours of delivery

Photos of the product must be provided
-
Packaging must be unopened and the product unconsumed
Requests submitted after 24 hours will not be evaluated.
If improper storage conditions are detected, the return request will be rejected.
9. Refund
If a return request is accepted:

The refund is issued using the same payment method used by the Buyer
-
Bank processing times may vary between 1 to 7 business days

For credit card refunds, the relevant bank’s procedures apply
10. Warranty
No warranty applies to food products.
All products are prepared fresh, hygienically, and under appropriate conditions.
11. Privacy and Personal Data
The Buyer’s personal data is processed in accordance with KVKK.
Details are provided in the Privacy Policy and KVKK Information Notice.
12. Force Majeure
Deliveries may be delayed or halted due to events beyond the Seller’s control, including:
Natural disasters, fire, flood, war, mobilization, terrorism, strikes, quarantine, pandemic, operational courier issues, or other force majeure situations.
The Seller cannot be held responsible in such cases.
13. Dispute Resolution
In the event of a dispute, İzmir Central Courts and İzmir Enforcement Offices shall have jurisdiction.
14. Enforcement
By approving this Agreement electronically, the Buyer is deemed to have accepted all of its provisions.
This Agreement is established electronically and becomes binding on the Parties.
