Membership Agreement

Ağam Baklavaları Gıda Ürünleri Ticaret ve Sanayi Ltd. Şti.

All users (“Member”) who create an account on the website located at www.agam.com.tr (“Site”) are deemed to have accepted the terms of this Membership Agreement.
This Agreement has been prepared in accordance with the Consumer Protection Law No. 6502, the Law No. 6563 on the Regulation of Electronic Commerce, the Turkish Code of Obligations, and all other applicable legislation.

1. Parties

This Agreement is executed between:

and the real person who becomes a member of the Site (“Member”).

2. Scope and Conditions of Membership

Membership begins when the Member creates an account on the Site. The Member agrees that:

  • All information provided is accurate and up to date

  • The membership account will be used solely by the Member

  • The Member is solely responsible for the security of their password

  • Membership cannot be transferred to another person

The Site reserves the right to reject membership applications or request additional information.

3. Rights and Obligations of the Parties

3.1 Member’s Obligations

The Member agrees to:

  • Use the Site in compliance with laws, ethics, and good faith

  • Avoid harming the rights of third parties

  • Be fully responsible for all transactions carried out through their account

  • Not share their account with third parties

  • Not provide incorrect, incomplete, or misleading information

  • Not upload viruses, malicious software, or take actions that may damage the system

3.2 Rights of Ağam Baklavaları

The Company reserves the right to:

  • Modify or remove any content on the Site at any time

  • Suspend or terminate the Member’s account

  • Limit access to the Site for technical reasons

  • Change campaigns, product information, services, and prices

  • Temporarily suspend access to the Site for maintenance or updates

The Company accepts no liability arising from these actions.

4. Termination of Membership

The Member may request account closure at any time. The request will be processed within a reasonable period.

Ağam Baklavaları may immediately terminate a membership in the following cases:

  • Providing false or misleading information

  • Suspicion of payment fraud

  • Violation of third-party rights

  • Technical actions intended to harm the Site

  • Breach of Agreement terms

Termination of membership does not eliminate obligations arising from past transactions.

5. Conditions Regarding Products and Services

The Member acknowledges that:

  • Product information, images, prices, and campaigns on the Site may change

  • Orders may be canceled due to stock or technical issues

  • Sales are not finalized until order confirmation, payment confirmation, and stock availability are verified

Since the products consist of fresh food items, responsibility passes to the customer after delivery.

6. Electronic Commercial Messages

If the Member gives explicit consent, they may receive:

  • Campaign announcements

  • SMS notifications

  • E-mail newsletters

  • Special offers

Consent can be withdrawn at any time through the membership panel or the “unsubscribe” link in the messages.

7. Intellectual Property Rights

All content on the Site (photos, videos, designs, texts, trademarks, logos, etc.) is the exclusive property of Ağam Baklavaları.

The Member may not:

  • Copy

  • Republish

  • Modify

  • Use for commercial purposes

  • Share without permission, even with attribution

Any violation may result in legal and criminal liability.

8. Processing of Personal Data

The Member’s personal data is processed in accordance with KVKK.
Detailed information is available in the “KVKK Information Notice” and “Privacy Policy”.

By accepting this Agreement, the Member acknowledges having read these documents.

9. Amendments to the Agreement

Ağam Baklavaları may update the Agreement when necessary.
The latest version is always available on the Site.

Continued use of the Site after changes indicates acceptance.

10. Applicable Law and Jurisdiction

Turkish Law applies to all disputes arising from this Agreement.
Authorized courts and enforcement offices:

  • İzmir Central Courts

  • İzmir Enforcement Offices

11. Enforcement

By clicking the “Create Membership” button on the Site, the Member declares that they have read, understood, and accepted all terms of this Agreement.

This Agreement enters into force upon electronic approval by the Member.
